Service Terms & Conditions (Version 1.00)
1. Warranty Coverage
- Parts Replacement: Our warranty strictly covers only those parts that have been replaced or repaired by Summit Power Company for Electrical Industries.
- Rewinding Services: If rewinding is performed as part of the service, the warranty will extend to cover the rewinding work executed by our team.
- Exclusions: No warranty is provided for any components not serviced by us. This includes any parts that may subsequently be damaged as a consequence of a failure in a repaired component. For basic overhaul services, the warranty is limited solely to the parts that were replaced (e.g., bearings, housing, diodes). If rewinding is not performed, the winding remains excluded from warranty coverage.
- Warranty Terms on Invoice: Any warranty terms, including the warranty period and details of coverage, will be explicitly stated on the invoice. If no warranty information is provided on the invoice, the machine is deemed to have no warranty coverage.
2. Limitation of Liability
- The maximum liability for any claims arising from our service shall not exceed the total invoice amount. Under no circumstances will our liability exceed the invoiced amount.
3. Exclusions and Additional Terms
- Non-Service Components: Any parts or components that were not serviced, replaced, or repaired by Summit Power Company for Electrical Industries are excluded from this warranty.
- Third-Party Interventions: Any repairs, modifications, or alterations performed by any party other than our authorized technicians will void the warranty on those respective components.
- Consequential Damages: We are not liable for incidental or consequential damages that result from the failure of parts outside the scope of our repair or replacement services.
4. Invoice Disputes
- No invoice payment or processing shall be withheld or delayed due to any dispute related to another invoice. Each invoice will be addressed and resolved separately.
5. Delivery and Postponement
- Summit Power Company for Electrical Industries reserves the right to postpone the delivery date under the following circumstances:
- If the customer fails to pay repair payments as agreed.
- If a delay is caused by force majeure, an act of God, or any other event beyond our control.
- If additional work, not initially agreed upon, is required and extends the repair period.
6. Machine Pickup, Storage Charges, and Liability for Uncollected Equipment
- The customer is required to collect the machine within 30 days following notification that it is ready for pick-up.
- Should the machine not be collected within this period, Summit Power Company for Electrical Industries reserves the right to impose a storage fee of 100 SAR per day for each day beyond the initial 30-day period.
- The customer further releases and acquits the company from any technical or financial liability arising from any delays or failures in collecting the machine.
- Summit Power Company for Electrical Industries shall not be liable for any loss or damage to the equipment, including total loss, if the customer fails to collect it.
7. Acceptance of Terms
- By accepting our service, the customer acknowledges and agrees to these terms and conditions.
- Any claims or disputes must be raised within the warranty period as indicated on the invoice.
8. Amendments and Updates
- Summit Power Company for Electrical Industries reserves the right to modify these terms and conditions at any time.
- The specific version of these terms and conditions that applies to each quotation is Version 1.00 and will be clearly indicated on the quotation, which will govern the services provided under that quotation.
- Any updates will be posted on our website at conditions.summitksa.com.
9. Communication and Official Contacts
- When Summit Power Company for Electrical Industries communicates with the client via email regarding the machine's readiness, the client is responsible for providing accurate and current contact information.
- The email address and other contact details provided by the client will be treated as the official contacts for all notifications and communications.
- It is solely the client's responsibility to ensure that the provided contact information is correct and up-to-date.
- Summit Power Company for Electrical Industries assumes no liability or responsibility for verifying the accuracy of the provided contacts.
- Any communications sent to the provided contacts will be considered as officially approved by the client.
- If the company fails to contact the customer, and the customer remains unreachable or "disappears" for more than 30 days after the agreed delivery date, then the terms regarding failure to collect the machine (as outlined in Clause 6) shall apply.
10. Cancellation of Service
- Summit Power Company for Electrical Industries reserves the right to cancel or discontinue service for an approved job at any time if technical disputes, financial disputes, or any other disputes arise between the company and the customer, and the company elects not to continue with the job.
- In such event, no additional liability shall be incurred by the company, and the maximum liability shall be limited to the refund of any advance payment received for the job.
- By accepting our service, the customer acknowledges and agrees to this cancellation right.
الشروط والأحكام الخاصة بالخدمة (النسخة 1.00)
1. تغطية الضمان
- استبدال الأجزاء: يغطي ضماننا بشكل حصري الأجزاء التي تم استبدالها أو إصلاحها من قبل شركة قمة الكهرباء للصناعات الكهربائية.
- خدمات إعادة اللف: في حال تم إجراء عملية إعادة اللف كجزء من الخدمة، يتم تمديد الضمان ليشمل أعمال إعادة اللف التي ينفذها فريقنا.
- الاستثناءات: لا يشمل الضمان أي مكونات لم يتم خدمتها من قبلنا، بما في ذلك أي أجزاء قد تتعرض للتلف لاحقًا نتيجة لفشل أحد المكونات التي تم إصلاحها. بالنسبة لخدمات الصيانة الأساسية، يقتصر الضمان على الأجزاء التي تم استبدالها (مثل المحامل، والغلاف، والديودات). وفي حال لم يتم إجراء إعادة اللف، فإن اللف يظل مستثنى من تغطية الضمان.
- شروط الضمان في الفاتورة: يجب ذكر شروط الضمان، بما في ذلك فترة الضمان وتفاصيل التغطية، بوضوح في الفاتورة. وإذا لم يتم ذكر معلومات الضمان في الفاتورة، يُعتبر أن الجهاز ليس عليه أي تغطية ضمان.
2. تحديد المسؤولية
- لا تتجاوز أقصى مسؤولية عن أي مطالبات تنشأ عن خدماتنا إجمالي مبلغ الفاتورة. ولن تتجاوز مسؤوليتنا تحت أي ظرف من الظروف المبلغ المذكور في الفاتورة.
3. الاستثناءات والشروط الإضافية
- المكونات غير المشمولة بالخدمة: أي أجزاء أو مكونات لم يتم خدمتها أو استبدالها أو إصلاحها من قبل شركة قمة الكهرباء للصناعات الكهربائية مستثناة من هذا الضمان.
- تدخلات الطرف الثالث: أي عمليات إصلاح أو تعديل أو تغيير يتم تنفيذها من قبل أي طرف آخر غير الفنيين المعتمدين لدينا ستلغي الضمان عن تلك المكونات.
- الأضرار العرضية: نحن غير مسؤولين عن الأضرار العرضية أو التبعية التي تنتج عن فشل أجزاء خارج نطاق خدمات الإصلاح أو الاستبدال.
4. نزاعات الفواتير
- لا يجوز حجب أو تأخير دفع أو معالجة أي فاتورة بسبب نزاع متعلق بفاتورة أخرى. سيتم التعامل مع كل فاتورة بشكل منفصل وتسويتها على حدة.
5. التسليم والتأجيل
- تحتفظ شركة قمة الكهرباء للصناعات الكهربائية بالحق في تأجيل تاريخ التسليم في الحالات التالية:
- في حال فشل العميل في دفع مبالغ الإصلاح وفقًا للاتفاق.
- إذا تسبب تأخير ناجم عن ظروف قاهرة أو قوة قاهرة أو أي حدث آخر خارج عن سيطرتنا.
- إذا تطلبت الأعمال الإضافية، التي لم يتم الاتفاق عليها في البداية، فترة زمنية أطول للإصلاح.
6. استلام الجهاز ورسوم التخزين والمسؤولية عن المعدات غير الملتقطة
- يجب على العميل استلام الجهاز خلال 30 يومًا من إشعار جاهزيته للاستلام.
- في حال عدم استلام الجهاز خلال هذه الفترة، تحتفظ شركة قمة الكهرباء للصناعات الكهربائية بالحق في فرض رسوم تخزين قدرها 100 ريال سعودي عن كل يوم إضافي بعد مرور فترة الثلاثين يومًا.
- يقوم العميل بموجب ذلك بإعفاء الشركة من أي مسؤولية فنية أو مالية قد تنشأ عن التأخير أو الفشل في استلام الجهاز.
- ولا تتحمل شركة قمة الكهرباء للصناعات الكهربائية أي مسؤولية عن أي خسارة أو تلف قد يحدث للمعدات، بما في ذلك الخسارة الكاملة، في حال فشل العميل في استلامها.
7. قبول الشروط
- من خلال قبول الخدمة، يقر العميل بموافقته على هذه الشروط والأحكام.
- يجب تقديم أي مطالبات أو نزاعات خلال فترة الضمان كما هو مذكور في الفاتورة.
8. التعديلات والتحديثات
- تحتفظ شركة قمة الكهرباء للصناعات الكهربائية بالحق في تعديل هذه الشروط والأحكام في أي وقت.
- النسخة المحددة التي تطبق على كل عرض أسعار هي النسخة 1.00، وسيتم ذكرها بوضوح على العرض لتكون ملزمة للخدمات المقدمة بموجبه.
- سيتم نشر أي تحديثات على موقعنا الإلكتروني conditions.summitksa.com.
9. التواصل ومعلومات الاتصال الرسمية
- عند تواصل شركة قمة الكهرباء للصناعات الكهربائية مع العميل عبر البريد الإلكتروني بخصوص جاهزية الجهاز، يكون العميل مسؤولاً عن تقديم معلومات اتصال صحيحة ومحدثة.
- تُعتبر بيانات البريد الإلكتروني ومعلومات الاتصال الأخرى التي يقدمها العميل كجهات الاتصال الرسمية لجميع الإشعارات والتواصل.
- تقع المسؤولية الكاملة على عاتق العميل للتأكد من صحة وتحديث معلومات الاتصال المقدمة.
- لا تتحمل شركة قمة الكهرباء للصناعات الكهربائية أي مسؤولية أو التزام بالتحقق من دقة معلومات الاتصال المقدمة.
- سيتم اعتبار أي تواصل يُرسل إلى معلومات الاتصال المقدمة بمثابة موافقة رسمية من قبل العميل.
- إذا فشلت الشركة في التواصل مع العميل وظل العميل غير متاح لأكثر من 30 يومًا بعد تاريخ التسليم المتفق عليه، فإن أحكام عدم استلام الجهاز المنصوص عليها في البند 6 تنطبق.
10. إلغاء الخدمة
- تحتفظ شركة قمة الكهرباء للصناعات الكهربائية بالحق في إلغاء الخدمة أو وقف تنفيذ العمل الذي تمت الموافقة عليه في أي وقت إذا نشأت نزاعات تقنية أو مالية أو أي نزاعات أخرى بين الشركة والعميل، وفي حال قررت الشركة عدم استكمال العمل.
- في مثل هذه الحالة، لا تتحمل الشركة أي مسؤولية إضافية، وتقتصر المسؤولية القصوى على استرداد أي مبلغ مدفوع مقدماً مقابل العمل.
- بقبول الخدمة، يقر العميل بموافقته على هذا الحق في الإلغاء.
